  1. Scope and Application:
  2. These terms and conditions (“Safeguard Terms”) govern all shipments handled by wOow for which the customer opts into the Safeguard Protection plan. To qualify, the customer must:
  • Subscribe to the Safeguard Protection by agreeing to the Safeguard Terms online or by signing the Safeguard Application Form.
  • Declare the value for the non-document goods they are shipping.
  • Pay the agreed Safeguard Protection fees, as indicated online at woowbd.com or on the Safeguard Application Form (such shipments are hereafter referred to as “Safeguard Shipments”).
  1. Relation to Other Agreements:
  2. These Safeguard Terms are supplementary to:
  • Any previously agreed terms and conditions between wOow and the customer (“T&C”).
  • The Conditions of Carriage found on the standard wOow waybill issued for the Safeguard Shipment. These terms are applicable for both Import Express and Export Express shipments (available at https://www.woowbd.com/shipping-terms/), as well as for International shipments (https://www.woowbd.com/shipping-terms/international). Copies of these waybills are available on request.
  1. Integration of Agreements:
  2. The Safeguard Terms are meant to integrate with any pre-existing agreements (T&C) and the Conditions of Carriage (WAYBILL). Together, they form a binding contract between wOow and the customer for all Safeguard Shipments. The intention is for the T&C and the WAYBILL, as adjusted by the Safeguard Terms, to remain fully enforceable.
  3. Definitions:
  4. Unless otherwise stated, terms defined in the T&C or WAYBILL will carry the same meaning in these Safeguard Terms.
  5. Limitations and Restrictions on Shipments:
  6. The enhanced liability coverage in clause 7 only applies to Safeguard Shipments that adhere to these conditions:
  • Safeguard Shipments must not include restricted items such as animals, dangerous goods, perishables, jewelry, precious metals, and items prohibited by law in either the country of origin or destination. A full list of prohibited items can be found at woowbd.com/Safeguard/exceptions.
  • This list can be updated by wOow without notifying the customer. Customers are responsible for ensuring their shipment complies with the restrictions before shipping.
  1. Country Exclusions:
  2. Safeguard Protection is not available for shipments to or from certain high-risk countries, including but not limited to Afghanistan, Iran, North Korea, and others listed on wOow’s restricted country list at woowbd.com/Safeguard/countries. The list of excluded countries may be amended without prior notice.
  3. Liability Coverage:
  4. When a customer declares a value exceeding the standard liability limits in Section 4(a) of the WAYBILL, wOow’s liability for loss or damage is capped at the declared value. For partial losses or damages, compensation will be pro-rated based on the declared value.
  5. Limits on Liability:
  6. Enhanced liability protection does not apply to shipments of non-document goods valued over $1,000 or document shipments valued over $30.
  7. Maximum Declared Value:
  8. The maximum declared value allowed is $1,000 for non-document shipments and $30 for document shipments. By declaring the value, the customer confirms the declared amount accurately reflects the goods’ worth.
  9. Valuation of Goods:
  10. The valuation of Safeguard Shipments will be done as per Section 4(c) of the WAYBILL. This valuation process helps wOow determine compensation in case of loss or damage.
  11. Exclusions from Coverage:
  12. Safeguard protection will not apply in cases where loss or damage arises from:
  • Willful misconduct by the customer, shipper, or carrier.
  • Ordinary wear and tear or loss in weight/volume during transit.
  • Inadequate packaging or preparation by the shipper.
  • The inherent nature of the goods being shipped (e.g., perishable goods).
  • Loss or damage caused by atomic or nuclear reactions or radiation.
  • Lost or taken away parcels item during customer border inspection.

 

  1. Claims for Loss or Damage:
  2. Claims for loss or damage must be submitted within seven (7) days of delivery or the expected delivery date. Claims should include documentation such as the WAYBILL, commercial invoice, photos of damage, and a packing list, if applicable. If damage is visible on delivery, the consignee must open the package immediately to mitigate further damage.
  3. Claim Resolution and Recovery:
  4. wOow will review and settle claims within 30 days of receiving the required documentation. If a lost shipment is recovered after a claim is settled, the customer must return the full claim amount within ten (10) days of notice or relinquish ownership of the shipment to wOow.
  5. Amendments to Safeguard Terms:
  6. wOow reserves the right to change these Safeguard Terms without prior notice. Any changes will take effect ten (10) days after being posted on the wOow website.
